ACCEPTANCE

By visiting the Website, using its services or interacting with the Company, the user confirms that they have read and understood this Privacy Policy and agree that the Company may collect, use, store, transmit and disclose the personal data collected through the Website in accordance with this Privacy Policy. The Company may ask the user to provide consent (for example, by ticking a box) where it deems it appropriate to safeguard their rights or where required by applicable regulations. If the user does not accept the terms of this Privacy Policy, they are requested not to visit this Website, not to use it in any way and not to submit personal data or provide consent when such an option is offered pursuant to applicable laws.  

1.      PROCESSING OF PERSONAL DATA

In this Privacy Policy, the term “Personal Data” refers to any information that allows the Company to identify the user (or a third party whose data the user provides), directly or indirectly, including any information related to the purchase of goods or services, or information that the user chooses to communicate to the Company or share with it or with third parties while using the Website. Personal data will be processed in accordance with Regulation (EU) 2016/679 “GDPR” and Legislative Decree 196/2003. The Company reserves the right to carry out further data processing where required by law or in connection with investigations or criminal or other proceedings.  

2.      PERSONAL DATA COLLECTED

a) Data source
The Company collects personal data from the user only when the user voluntarily provides information, for example:

  • when requesting information through the website contact form;
  • when sending emails, SMS or other electronic messages;
  • when requesting to subscribe to the mailing list;
  • when requesting to book the services offered.

b) If the user provides the Company with personal data of third parties (e.g. family members, other clients or potential clients), the user must ensure that such third parties are informed and have authorized the use of their data as described in this Privacy Policy.  

c) The Company may collect and use different types of personal data depending on the specific purposes pursued, including:

  • personal information such as first name, last name, gender, age/date of birth, country of origin and other personal data permitted by applicable regulations;
  • contact information such as address, email address, telephone number, mobile phone number, fax number (if any) and other contact details permitted by applicable regulations;  

3.      PURPOSES OF PROCESSING PERSONAL DATA

Depending on the specific circumstances in which the interaction between the user and the Company occurs, personal data will be used for the purposes for which it was voluntarily provided.

Personal data provided by the user or collected when requesting a specific service—namely personal and contact information strictly necessary to process the request—will be used to:

  1. provide the requested services (e.g. assisting the user, responding to questions or contact requests, including those submitted through the contact form);
  2. manage newsletter subscriptions where the user has given specific consent.
  3. Providing personal data for the above purposes is necessary; refusal would make it impossible to process the request.
  4. Except where otherwise required by applicable local regulations, processing for these purposes may be carried out without the user’s consent, as it is necessary to fulfill the request.
  5. Personal data provided by the user while visiting the Website or interacting with the Company may be entered into a centralized database to offer promotions, discounts and personalized services and to send newsletters, marketing and commercial communications about the Company’s products and services, event invitations, surveys, market research, prize contests or promotions and other initiatives (“marketing”). The Company may use traditional (postal mail, telephone) and/or digital and automated contact methods (email, SMS, MMS, telephone and other digital channels such as social media).

Inclusion of data in the database is optional and free of charge (as it is based on consent that the user may choose to provide) and may occur only when personal data is provided for the marketing purposes referred to in point 3.2. The user may unsubscribe or withdraw consent at any time (see point 8). In any case, refusal to provide personal data for marketing purposes does not prevent the user from using the Company’s services, but the Company will not be able to inform the user about marketing initiatives and events described above.   

4.      DISCLOSURE OF PERSONAL DATA

The Company shares the user’s personal data with its affiliated companies, distributors and affiliates, including those located in other countries, and with other companies that provide services on its behalf, under its direction or that of third parties. These entities will receive only the personal data necessary to perform the services and will not be authorized to use it for other purposes.

a) Disclosure to data processors
When the user subscribes to the newsletter or uses the Company’s online contact services, personal data may be shared with selected third parties providing services to the Company. Data may be shared to monitor and analyze Website activity, host Website content, provide technical and organizational services, maintain the customer database, provide marketing assistance and manage emails, market analysis, surveys, contests, promotions or prize initiatives. Such third parties may access, store or process personal data in Italy, the user’s country or abroad. Service providers are not authorized to use personal data for purposes other than providing contracted services.  

b) Disclosure of personal data
In the event of corporate transactions (e.g. mergers, acquisitions, restructuring or liquidation), customer data may be transferred as part of company assets, in compliance with applicable law and legitimate interests. Personal data will remain subject to the existing privacy policy unless otherwise decided by the user. The Company may also disclose personal data:

  • where required by EU or Member State law;
  • in the event of legal proceedings;
  • in response to lawful requests by law enforcement authorities;
  • to protect the rights, privacy, safety or property of the Company or the public.

5.      PROTECTION OF MINORS’ PRIVACY

This Website is intended for a general audience; however, its services are intended for individuals aged 18 or over. The Company does not knowingly collect or process personal data from minors. If such data is discovered, it will be deleted. Users under the required age are asked not to proceed and to seek assistance from a parent or legal guardian.  

6.      STORAGE, ACCESSIBILITY AND TRANSFER OF PERSONAL DATA

Personal data collected through the Website is mainly processed electronically using web-based tools, including web analytics services hosted on servers within the European Union. Data may also be processed on paper. In all cases, data is stored in a centralized database secured by the Company in Italy.  

Access to personal data is restricted to authorized personnel only and subject to confidentiality obligations. Where marketing consent has been provided, data may be accessed by sales and marketing staff trained in data protection.  

If data is transferred outside the user’s country, the Company will ensure compliance with EU data protection standards or equivalent safeguards.

7.      SECURITY AND CONFIDENTIALITY OF PERSONAL DATA

The Company has implemented appropriate measures to protect personal data from accidental loss and unauthorized access, use or disclosure. However, absolute security cannot be guaranteed. Data is provided at the user’s own risk. Users are advised to keep their systems updated and protected.

Users may access, update, correct, delete or transfer their personal data at any time, free of charge, by contacting the Company at info@hotelmarilena.it or by mail (see point 12). Complaints may be filed with the competent data protection authority.  

9.   DATA RETENTION

Personal data will be retained for the duration of the business relationship and as required by law. Marketing data will be retained until consent is withdrawn.
